  1. what is Federalism? Federalism is two or more governments exercise the use of power and authority over the same people in the same territory
    1. Types Of Federalism:
      1. Dual Federalism: Federal and state governments remain dominant in their separate spheres of influence
        1. Cooperative Federalism: State and Federal governments work together to solve complex problems
          1. Fiscal Federalism: the pattern of spending, taxing and providing grants in the federal system. always deals with money...... FISCAL MEANING $$ MONEY$$
            1. Grants in Aid
              1. Categorical : target specific purposes
                1. block: given for broad, general purposes and allow more discretion on how the money is spent
                  1. formula: funding is allocated to recipients based upon a set of pre-existing criteria. Aid To Families With Dependent Children
                    1. Project: fund specific projects or the delivery of specific services for a fixed period of time.
                      1. Mandate
                  2. POWERS
                    1. Implied Powers
                      1. The national gov’t has certain implied powers that go beyond delegated powers. according to McCulloch case.
                  3. Advantages: Brings gov’t closer to people Allows for state gov’t to address issues in unique regions of the country, Allows states to experiment with policy before enacting it at the federal level
                    1. Disadvantage: States can impede progress of Nation, States are unequal, and States have different policies
                    2. Importance? Defends the Constitution, also defends the separation of powers between state and national government.
                      1. Constitutional Basis of Federalism
                        1. Division of Powers: Federalism is a system of government in which a written constitution divides the powers of government on a territorial basis.
                          1. The division is made between a central, or national, government and several regional or local governments. Each level of government has its own area of powers. Each level operates through its own agencies and acts directly on the people through its own officials and laws.
                            1. why ? so one branch wont become to Powerful
                            2. Supremacy Clause
                              1. states that the US Constitution is the highest law of the US
                            3. 10th Amendment: its an amendment in the constitution that states that power is not just given to the federal government but to the people.
