A judge can apply a two stage test to determine dishonesty, this test was derived from the the case of;

A person will not be regarded as dishonest if they believed that either; 1.They had a right in law to the property. 2.If the owner knew of the appropriation and the circumstances (why it was taken), they would have consented 3. The owner cannot be discovered by taking reasonable steps.
