    • Any act which intentionally or recklessly, causes another person to apprehend immediate and unlawful personal violence.

      1. Mens Rea

        Anotações:

        • The defendant must INTEND to cause the victim to apprehend immediate and unlawful personal violence or be Reckless as to whether such apprehension be caused. 
      2. Battery

        Anotações:

        • The infliction of the violence intentionally or recklessly.
        1. Actus Reus

          Anotações:

          • The infliction of unlawful personal violence on the victim.  
          1. Mens Rea

            Anotações:

            • Intentionally or Recklessly inflict the unlawful violence. 
          2. Assault occasioning actual bodily harm s.47 of the OAPA

            Anotações:

            • Any assault occasioning actual bodily harm.
            1. Actus Reus

              Anotações:

              • An assault, which occasions (causes), actual bodily harm.
              1. Mens Rea

                Anotações:

                • Intention or Recklessness. 
              2. Wounding or inflicting grievous bodily harm (s.20 of the OAPA 1861

                • Unlawfully and maliciously wound or inflict any grievous bodily harm upon any other person.

                  Anotações:

                  • To wound or inflict grievous bodily harm.
                  1. Mens Rea

                    Anotações:

                    • Maliciously wounding or inflicting grievous bodily harm. (maliciously denotes two alternative mens rea states: (i) Intention and (ii) Subjective recklessness.
                  2. Wounding or causing grievous bodily harm with intent (s.18 of the OAPA 1861

                    Anotações:

                    • Whoever shall unlawfully and maliciously by any means whatsoever wound or cause any grievous bodily harm to any person... with intent...to do some...grievous bodily harm to any person, or with the intent to resist or prevent the lawful apprehension or detainer of any person,

                      1. Mens Rea

                        Anotações:

                        • Maliciously wound or cause grievous bodily harm. Intend either grievous bodily harm, or to resist or prevent the lawful apprehension or detainer of any person. The prosecution must always establish one of these ulterior intents.
