  1. Brown VS. Board of Education
    1. Disability Advocacy group sees disability Civil Rights Parallels
    2. Section 504 of the Rehabilitation Act of 1973 (PL 93-112)

      Nota:

      • States that, " no otherwise qualified handicapped individual in the United States, shall solely by reason of his handicap, be excluded from the participation in, be denied the benefits of  or be subjected to discrimination under any program or activity receiving federal financial assistance. 
      1. Education for all handicapped Children Act of 1975 (Pl 94-142)

        Nota:

        • This law was singularly responsible for setting in motion the kind and quality of education for children with disabilities that we see today. This law is regarded as a major turning point in special education, including physical education. 
        1. Called for Education in the least restrictive environment (LRE)
        2. Explicit Inclusion of physical Education

          Nota:

          • Physical education services specially designed if necessary must be made available to every child with a disability receiving free appropriate public education (FAPE).
          1. Education for all handicapped children act (PL 99-457)

            Nota:

            • Students ages from 3-21 years of age were to be covered in all states to receive education.
            1. Americans with Disabilities Act

              Nota:

              • The law states in essence that individuals with disabilities must be provided equal opportunities in all aspects of life.
              1. Individual with Disabilities education act of 2004

                Nota:

                • Prominent changes in IDEA  2004 focused on three general areas; the IEP process, due process, and discipline. 
                1. No Child Left Behind Act

                  Nota:

                  • Signed into law in 2002. States that.  ...to insure that all children have a fair, equal, and significant opportunity to obtain a high quality education and reach, at a minimum, proficiency on challenging state academic achievement standards and state academic assessments.
