nonbinding, and in
binding arbitration both
parties agree to the
arbitrator's conclusion.

Litigation takes place
when the two parties
cannot agree or require a
judgement, or has
criminal conduct.
Provides both parties with
the ability to supply
evidence to the claims.
There is still a negotiation
process before going to trial.

Litigation cost more that both
Mediation and Arbitration.
Litigation usually takes longer to
come to a conclusion. One or
both parties may not be happy
with the outcome.
